Non-immigrant Visa
Foreigners must apply for a Non-Immigrant Visa at the Royal Thai Embassies or Royal Thai Consulates-General in their home countries by specifying the reasons of entry into Thailand in visa application form.
In order to be granted work permit, it is indicated that the alien must apply for visa which is not tourist or in transit visa. The alien who wish to apply for this type of visa must fill in visa application form by specifying the reasons of apply for the visa and submit to the Royal Thai Embassies or Royal Thai Consulates-General in their home countries. Since this type of visa is very important on that it can be used to support work permit request and permit the alien to stay in Thailand as long as needed, such visa will be issued as sticker attached to the passport. However, some Royal Thai Consular especially Royal Honorary Consular are still using seal. Such sticker or seal will contain the message indicated the type of visa and its code for example, if apply for working visa, the visa will indicate “NON IMMIGRANT VISA Class B”, if apply for study visa, the visa will indicate class ED or O means others. Such visa will indicate the duration of time to use visa until its expiration. This duration of time is usually misunderstood. It is understood that such indication is the duration permitted to stay in Thailand. Actually, the seal is permitted an alien to stay in Thailand for the period of 90 days even he/she has entered Thailand on the last day of the date specified on visa.
In addition, even if there is the word “NO EXTENSION OF STAY” appeared on visa, an alien has entitled to apply for an extension according to his/her reason and necessity. If the authorized person considers that the reason or necessity is rational, he/she will permit such alien to temporarily stay in Thailand.

1.1 Register the corporate name with the Ministry of Commerce.
1.2 File a Memorandum of Association for formation of

Processing times vary depending on the type of business and
the specific requirements necessary for each. In general, if no documents
are returned and no additional documentation is required by the Ministry
of Commerce, the process can take about 17 days. However, the process
involves coordinating the preparation of documents from at least seven
shareholders, the company directors, and other individuals involved. Also
the documents may not be submitted at one time, but have to be submitted
in three stages. As a result, most company registrations take longer than 17 days.
Capital required is dependent on the needs of the business.
There is no minimum requirement for registered capital.
Statutory minimum capital requirements are five baht per share.
In general the lowest capitalization normally generally seen is 100,000
baht. However, a majority foreign owned company (or a company
sponsoring a foreigner 's work permit) requires a minimum of 2,000,000
baht capital. When determining the practical amount of capital necessary
for starting a business all costs need to be considered: leases for office
and warehouse space, utility and housing costs, staff salaries, etc.
Doing business in Thailand can be very complicated and may

The Treaty of Amity and Economic Relations Between Thailand
and the United States of America

Excluding the seven stated exceptions enumerated in the
Amity Treaty, Americans have rights the same as any Thai national

With the increasing importance of intellectual property within
the Thai economy and the global trading systemas well as the expanded
usage of intellectual property to gain a competitive edge, restrict trade,
bargaining chip in trade negotiations, especially by developed countries,
the Ministry of Commerce thus deemed it necessary to integrate all the
intellectual property-related activities under one roof. Accordingly, this led
to the integration of patents and trademarks related operations, which were
under the Department of Commercial Registration at the Ministry
of Commerce, with those relating to copyrights, under the Department
of Fine Arts at the Ministry of Education, so as to create a new department
under the Ministry of Commerce, or the Department of Intellectual Property.
Thai Intellectual Property Law
Patent is a type of intellectual property that is most familiar
to everyone. It is possible to say that patent is related to everyone’s
daily life in thatproducts that people use every day are the results of
human inventions, such as the creation of detergent, which is now
highly condensed and very effective in cleaning. Therefore, a patent
has contributed to more conveniences and a better and safer living standard.
Patent means important document issued by the government to
protect an invention, a product design, or a utility model as provided
under the laws.
Invention means innovation on composition, structure or of a
product, production and maintenance processes, as well as quality improvement.
Product Design means innovation related to modification of exterior
feature of a product for beautification and differentiation.
Utility Model or also called Petty Patent is similar to invention
but the level of technological innovation is not high or it is a result of
minor innovation.
Trademark means a mark, a symbol, or label used for a product or
service as the following. Protection for a trademark is provided
under the Trademark Act (No.2) B.E. 2543 (2000). The trademark
law provides protection for 4 categories of trademarks as follows:
1. Trademark is a mark that is used in conjunction with
goods to present that the goods is different from other goods that
use other trademarks, such as Ma-Ma (instant noodle) and Red Bull.
2. Copyrights mean exclusive right to undertake any activity
that is related to works that an innovator has created. A copyright
is a work that resulted from intellectuality, knowledge, and
assiduousness to innovate the work. It is considered a type of
intellectual property that has economic value. Therefore, an owner
of a copyright should be protected under the law.
3. Rights under copyrights will be acquired immediately
after an innovator developed the work without registration
requirement. The owner of copyright should therefore protect
the work by bringing togetherrelevant evidence that may be used
to prove the ownership of the work in the future.
4. Innovative works that are considered copyright comprise
of different types of works as follow:
4.1. Literary work, such as book, periodicals, article,
publication, and computer program;
4.2. Choreographic work, such as cultural dance, dancing,
posture or a performance that is composed in to a story, as well as
pantomime;
4.3. Artistic work, such as painting, sculpture, graphic arts,
architecture, photography, plan chart picture, applied art including
photograph and diagram of the work;
4.4. Musical work, such as melody and lyrics or only melody
including a well composed tones and chorus;
4.5. Audiovisual, such as video tape and laser disc;
4.6. Cinematography, such as movie and supporting sound of
the movie (if available);
4.7. Sound recording, such as cassette tape and compact disc;
4.8. Sound and picture broadcast, such as radio broadcast, or
sound and picture broadcast via a television station;
4.9. Other works that are related to the literary, scientific, and
art domains.
Traditional Knowledge
Traditional knowledge of local wisdom and cultural heritage that
exists in Thailand can be separated into categories :
1. Traditional knowledge of local wisdom such as food and
beverage production, herbal products, urplus material products and
products that are made from wood, stone, metal, glass, ceramic,
baked clay, leather and the like.

7. Property

In many areas of Thailand a foreign investor can acquire
up to, but not exceeding, 49% of the total floor area of the combined
condominium units, other 51% must be owned by Thai nationals.
However, more than 49% of ownership may be allowable in certain
condominium buildings in Greater Bangkok and various other
municipalities and districts according to Ministerial Regulations.
Most of the financial institutions in Thailand provide loans
for real estate purchasing to Thais and Thai companies. It is common
for a real estate developer to arrange for his customers to have
a financing package from a financial institution. In most real estate
development projects, a down payment can be made in installments
from 10 to 24 months. After the down payment has been paid, the sale
contract will be made and the balance amount is paid through the loan,
which is financed from a financial institution. The financial institution
requires you to mortgage the property with it as collateral against the loan.
There are typically three different appraisal rates :
1. The government rate.
2. The appraisal company's rate.
3. The rate of fair market value of the land.
All purchase and sale of property in Thailand
There are :
1. A stamp Duty of 0.5%.
2. A transfer fee of 0.01%.
3. Business tax of 0.11% levied against an owner who has been in
registered possession of the property less than 5 years.
4. An income tax.
Although Thai law prohibits foreigners from owning land in Thailand,
foreigners have the right to own buildings. There are two ways :
1. Forming a joint venture with majority Thai ownership and
2. Procuring a long term lease with a right of renewal.
Buying a condominium
The only restrictions on purchasing a condominium, are that the
percentage of units sold to foreigners can not exceed forty nine percent
(49%) of the total number of units in the condominium block.
Leasing
Thai property law allows a foreign investor to lease land for a maximum
of 30 years, with lease renewal options of 30 years. Many foreign investor
choose this method to secure land or property ownership. In comparison
to setting up a company, land leasing is easier and requires less maintainance.

For more than two decades, successive Thai governments
have understood that for Thailand to be attractive to foreign investors,
there needs to be both progressive investment promotion policies
and sufficient infrastructure.
Accordingly, just as the Board of Investment developed policies
to meet the needs of investors, the government has continuously improved
the nation’s infrastructure, both in Bangkok and the provinces. Indeed,
in recent years, tremendous strides have been made, especially in
transportation projects.
New roads have been built and others widened to better handle the
number of vehicles on the roads, and as a result, travel times to Thailand’s
Eastern Seaboard and southern seaside resorts have been significantly
reduced. Bangkok’s two mass transit systems are now up and operational,
and this, too, has had a positive effect on traffic. Both lines of the BTS
Skytrain are in the process of being expanded and additional lines of the
subway system have been approved by the government and are in the
bidding process. In addition, the new Suvarnabhumi International Airport
opened on September 28, 2006.
Airports
Thailand has developed an extensive air transport network that
encompasses 28 commercial airports, meaning that all Thailand’s regions
are about an hour’s flight from Bangkok.In addition to Don Muang Airport
in Bangkok, which in 2005 handled in excess of 268,000 flights, 990.000
tons of cargo and 38 million passengers. Thailand has international airports
in Phuket, Chiang Mai, Hat Yai, Chiang Rai and Ko Samui.
Suvarnabhumi International Airport, the new international airport of
Thailand, has two parallel runways and 120 parking bays, enabling it to
handle 76 flight movements per hour, 45 million passengers per year,
and 3 million tons of cargo per year. In 2007, Subvarnabhumi handled
261,592 commercial flights, 41.2 million passengers, 1.2 million
tons of freight and more than 10,000 tons of mail.The Airports Authority
of Thailand has announced a 78-billion-baht expansion program for
Suvarnabhumi that will increase passenger handling capacity by 33%
from 45 million to 60 million within six years.
Road Network
Thailand is widely acknowledged as having the most extensive road
transportation network of more than 250,000 kilometers, more than 40%
of which are international standard highways that provide links to every
province. There are more than 225 km of inter-city motorways creating
links between Bangkok and other major regions of the Kingdom, and the
government is enhancing inter-city motorways, which are expected to
stretch to 4,150 kilometers of 4-lane roads.
New highways are constantly being built, including projects to link
Bangkok to the new Suvarnabhumi Airport, and an ambitious project to
speed transport time to Thailand’s southern provinces.
The signing of the Asian Highway Agreement on April 26, 2004
strengthens Thailand’s connection to the rest of the world for land-based
trade and transportation linking it to 32 countries in Europe and Asia.
The importance of these interconnections will increase dramatically as
Thailand’s free trade agreements with the People’s Republic of China,
ASEAN and India kick in, making Thailand a crucial hub for international
production and trade.
Seaports
Thailand’s water transportation system has long been an important part
of the country’s history and industries. With a coastline of 3,219 km and
over 4,000 km of inland waterways, Thailand’s water transportation and
ports infrastructure are essential to its overall transportation and trade.
There are currently 122 ports, wharves, and jetties able to accommodate
sea-going vessels engaging in international trade, including eight
international deep sea ports: These ports, located in Bangkok, Laem
Chabang and Map Ta Phut on Thailand’s Eastern Seaboard, and Sonkhla,
Satun, Narathiwat, Phuket and Ranong in the South, provide capacity of
more than 4.5 million TEU, a figure that is expected to double as current
expansion projects are completed.

with state-of-the-art equipment that can handles the latest generation of
container vesselsThe Laem Chabang Port's services include cargo

Rail and Mass Transit Systems
Thailand’s rail transportation, which dates back more than century, is
extensive, covering 4,000 kilometers on three lines, intersecting in
Bangkok. The system offers affordable transportation from the
Malaysian border to northernmost provinces and Kanchanaburi in
the west. The system connects with Malaysia’s national system, providing
direct linkages down to Singapore, and a railway link to across the
Mekong is under construction at Nong Khai.
To help alleviate traffic in Bangkok, the government has been developing
mass transit systems. In 1999, the first system, known as the Skytrain
(www.bts.co.th), opened on overhead tracks. The system covers 55
kilometers, serving 23 stations on two lines, and carries approximately
300,000 passengers per working day.
Extensions of both lines are underway, covering more than 10km, including
a route across the Chao Phraya River to Thonburi.
In mid-2004, the Bangkok Subway (www.mrta.co.th) opened, providing
service at 18 stations over a 20 kilometer distance. The system, which
intersects with the Skytrain, can carry 50,000 passengers an hour in each
direction. The government plans to expand the system to 297 kilometers
and 82 stations over the next six years.
Telecommunications
A wide range of telecommunication facilities are available across
the country. Fixed line telephones (offering international direct dial
connections at affordable prices) and mobile phones are readily available,
and access to the Internet is available though ADSL, satellite modems
and dial-up connections. In recent years, the speed of internet access has
increased while costs have declined, and this trend seems certain to continue.
International Schools
The government has recognized the need to promote the development of
international schools, both to permit the offspring of foreign investors to
obtain international-standard education and to facilitate Thai students to
prepare for tertiary education abroad. Accordingly, there are numerous
schools that follow the American, British and Japanese educational
system, and students from these schools are accepted at some of the
